1. Introduction
Hummingbird (humarb.com and its API, the "Service") is a tool for arbitrage traders. It reads public market, order-book and funding data from exchanges and third-party data providers (such as CoinGlass), runs simulated calculations for the amount you enter, and uses an AI model to screen and describe candidate routes.
The Service does not place or execute orders, hold or custody any funds or crypto-assets, access your exchange accounts or keys, manage portfolios, or act as an exchange, broker or investment adviser. Any trade you make happens outside the Service and is your own responsibility.
By using the Service, or by continuing to create an account or sign in, you agree to these Terms and the Privacy Policy. If you do not agree, do not use it.
2. Eligibility and your local law
- You must be 18 or older and legally competent.
- The Service is not directed at residents of mainland China, nor at persons in countries or regions under comprehensive UN, US, EU or UK sanctions, or anywhere local law prohibits or restricts crypto-asset trading, derivatives or related information services ("Restricted Jurisdictions").
- You are responsible for making sure that using the Service and any exchange is lawful where you are.
- We may restrict or stop service anywhere at any time.
3. No advice; disclaimers and assumption of risk
3.1 A tool, not advice. Everything on the Service — including "Actionable", "Hummingbird picks", break-even times, "72h expected net", 7-day backtests, engine verdicts and "How to operate" — is general information and arithmetic on public data, the same for every user, without regard to your finances, goals or risk tolerance. These words describe the result of a screen or a calculation. It is not investment, financial, legal, tax or other advice, nor an offer or solicitation to buy or sell anything. Whether and how you trade is entirely your decision.
3.2 Simulated calculations on public data. Data may be delayed, missing, wrong or interrupted. Calculations rely on assumptions (e.g. funding rates holding, book depth at the sample time, published fee schedules); actual fills, fees, slippage, funding and settlement can differ. We try to label sources and times but do not guarantee any data or calculation is accurate, complete or timely. Verify on the exchange before trading.
3.3 Backtests are history. Backtests and historical replays describe the past. They are not forecasts and do not predict future results.
3.4 Engine judgments are AI model output. Engine verdicts such as "Recommend", "Watch" and "Not recommended", together with their reasons and risk notes, are generated automatically by an AI model (via third-party model providers) from the attached evidence. They may be wrong, incomplete or outdated, or the model may abstain. Figures are computed by code; the AI only judges and explains. AI output is not advice and not a personal recommendation from us.
3.5 Assumption of risk. Crypto-assets and derivatives such as perpetual futures are very risky: funding can flip, spreads can widen, books can move before you trade, leveraged positions can be liquidated, and exchanges can halt, restrict withdrawals, change rules or fail. You can lose all capital. A hedged position is not risk-free. You understand and accept these risks.
3.6 Exchange links and referral links. The Service links to exchanges and other third-party sites. Some exchange links are referral or invite links (for example a venue name or logo, or a trade-page link carrying a referral code), and the operator may receive commissions or rewards from the exchange when you sign up or trade through them. This section is the disclosure; links are not individually labelled. Referral arrangements never change which routes are shown, their ranking or any number. Using them is optional — you can always visit the exchange directly. We are not affiliated with those exchanges and are not responsible for their services, legality, availability or security.
3.7 As is. The Service is in Alpha and provided "as is" and "as available", without warranties of any kind (including merchantability, fitness for a purpose, uninterrupted or error-free operation) to the extent the law allows.
4. Prohibited activities
You must not: (a) use the Service unlawfully, including money laundering or sanctions evasion; (b) circumvent rate limits or access controls; (c) attack, disrupt or reverse-engineer the Service or upload malicious code; (d) mass-scrape pages or call non-public endpoints; (e) resell, share or publish API keys, or redistribute or resell Service data as-is or use it to build a competing data service; (f) impersonate others or give false information; (g) use Service content to mislead others (e.g. presenting calculations as "guaranteed returns").
5. Accounts, paid plan and API
5.1 Accounts. Sign-in is provided by the third-party identity service Clerk (email, Google, X). Use a real email and keep your credentials and API keys safe; you are responsible for activity under your account. You may delete your account at any time from the account page.
5.2 Pro plan and refunds.
- Web features are free during Alpha. The Pro plan (including API) is renewed manually each month at the listed price (currently USD 19.50/month), collected through the third-party payment service Infini, with no automatic renewal or debit.
- Access starts after we verify payment with the provider; each payment adds one calendar month.
- This is a digital service activated immediately: no refunds once active, except (a) duplicate payments or payments not activated within 7 days; (b) API unavailable for more than 72 consecutive hours due to our fault — we extend access pro rata or refund; (c) where the law requires a refund.
- Crypto payments are refunded via the original route and currency; network fees are borne by us.
- Price changes are announced 14 days ahead and do not affect paid periods. You are responsible for any taxes.
5.3 API. API keys are for your own or your organisation's internal use; limits are shared per account and excess use is throttled. API output is likewise simulated calculation and information, not advice, and read-only keys cannot place orders or withdraw funds. Any automated trading you build on it is your decision and risk. Third-party data (e.g. CoinGlass) is also subject to its provider's terms. We may suspend or revoke keys for abuse.
6. Changes, suspension and termination
We may change, suspend or discontinue any part of the Service at any time. We may update these Terms and show the effective date on this page; material changes are notified to registered users 7 days ahead, and continued use means acceptance. If you breach these Terms or act unlawfully, we may suspend or terminate your account and keys; fees are not refunded on termination for breach. You may stop using the Service and delete your account at any time.
7. Intellectual property and feedback
The Service's software, design and the "Hummingbird / 蜂鸟" name and marks belong to us. Exchange names, marks and third-party data belong to their owners; charts use TradingView Lightweight Charts™. We may use any feedback you send, free of charge, to improve the Service.
8. Limitation of liability and indemnity
- To the maximum extent the law allows, we are not liable for: trading losses or lost profits; errors in data, calculations or AI output; the conduct, failure or insolvency of any exchange; liquidations; service interruptions; or any indirect, incidental or consequential loss.
- Our total liability to you is capped at the greater of the fees you actually paid us in the 3 months before the claim and US$100.
- You will cover us against third-party claims arising from your breach of these Terms or local law.
- Liability that the law does not allow to be excluded or limited (e.g. wilful misconduct, gross negligence, personal injury) is unaffected.
9. Governing law and disputes
- Talk first. If you have a dispute, email humarb.consent230@passinbox.com describing the issue and what you want. We will both try in good faith to resolve it within 30 days of our receiving your email.
- Then courts. If it is not resolved within 30 days, these Terms and any dispute arising from them are governed by the laws of the Hong Kong Special Administrative Region, and the courts of Hong Kong SAR have jurisdiction (small claims may go to the Hong Kong Small Claims Tribunal). Arbitration does not apply.
- Consumer protection. If you use the Service as a consumer, mandatory consumer-protection laws of your place of residence still apply, and nothing in this section takes away rights you have under them.
10. Miscellaneous
The Privacy Policy forms part of these Terms. If any provision is invalid, the rest remain in effect. Not enforcing a right is not a waiver. If the Chinese and English versions conflict, the Chinese version prevails. Operator: Leo · Contact: humarb.consent230@passinbox.com.
